Regulation (EC) No 2100/94 of 27 July 1994, was a system of Community plant variety rights as the sole and exclusive form of Community industrial property rights for plant varieties. The system is managed by the Community (CPVO).

CPVO is an agency self-funding of community with its own legal personality, the 27th April 1995 began. Since August 1997 CPVO in Angers was (France).

CPVO decides on applications for Community Plant Variety protection on the basis of a formal and a technical review of the candidate variety. A Community plant variety protection is for 25 or 30 years depending on the kind of valid. The rights are valid in all 27 EU Member States.

CPVO is by its President, a Vice President who manages both supported by the EU Council appointed. It consists of two units, the technical unit of the Finance and Administration Unit, all supported by information technology, human resources and legal services.

CPVO is supervised by a board composed of one representative of each Member State and the European Commission and their alternates composed.

An Appeal Board is responsible for appeals against decisions of the CPVO rule. An appeal against a decision of the Board reverses the court of first instance and then to the Court.
